Privacy Policy

This Privacy Policy explains how FusedMagic (“FusedMagic”, “we”, “us”, or “our”) collects, uses, and shares your personal data when you use our websites, applications, and services (together, the “Service”). We aim to collect only the data we need and to be clear about how we use it. If you have questions, you can reach us using the details at the end of this Policy.

What is personal data

We treat “personal data” as any information that identifies you or that can reasonably be linked to you — such as your name or email address, and also data that does not directly identify you but could be used to do so. Information that has been aggregated or de-identified so that it can no longer reasonably be linked to you is not treated as personal data under this Policy.

Your privacy rights

Depending on where you live, you may have the right to access, correct, export, restrict, or delete your personal data, to object to certain processing, and to withdraw consent. You can manage much of your information from your account, or contact us to exercise these rights; we will not treat you differently for doing so. We may decline a request where the law allows — for example, where we must keep data to comply with law, protect against fraud or security threats, or safeguard the rights of others. You may also have the right to complain to your local data-protection regulator.

Personal data we collect from you

The data we collect depends on how you use the Service, and may include:

  • Account data — your name, email address, and account status. If you sign in with Google, we receive your basic Google profile and email through Google’s secure sign-in; we never receive your Google password and request only the limited profile and email needed to create and secure your account.
  • Content — the photographs, images, and files you upload, and the project names, notes, and settings you add.
  • Device and usage data — information such as IP address, browser type, pages viewed, timestamps, and diagnostic data, used to operate and secure the Service.
  • Payment and transaction data — where you buy a paid plan, billing details and a record of the transaction, handled through our payment processor.
  • Fraud-prevention data — information used to detect and prevent abuse and to keep accounts secure.

You do not have to provide the data we request, but if you choose not to, we may be unable to provide some or all of the Service.

Personal data we receive from other sources

We may receive data about you from people acting at your direction, or from partners who help us operate, secure, and protect the Service — for example, to validate the information you provide or to help prevent fraud.

How we use personal data

We use personal data to provide and improve the Service, process your transactions, communicate with you, keep the Service and its users secure, and comply with law. We rely on a valid legal basis for each use — including your consent, performance of our contract with you, our legitimate interests (weighed against your rights), or a legal obligation. Examples include:

  • operating the Service, including enhancing, organizing, and delivering your images, and troubleshooting and improving our offerings;
  • processing payments and managing subscriptions or credits;
  • sending you important account, transaction, and policy notices (which you cannot opt out of while you hold an account), and, where permitted, other communications;
  • detecting, preventing, and responding to fraud, abuse, and security incidents;
  • meeting our legal, tax, and reporting obligations.

Image processing and AI

To enhance your photos, we process the images you upload and may use trusted third-party image-processing providers acting on our behalf under confidentiality and no-retention terms. We do not use your images to train models unless you explicitly opt in. You retain ownership of your content; see our Terms of Service.

How we share personal data

We do not sell your personal data, and we do not share it for others’ own marketing purposes. We share it only:

  • with service providers who process or store data on our behalf — such as hosting, storage, image processing, and payments — under contracts that limit their use to providing services to us; a current list of providers is available on request;
  • where you direct us to, or with your consent;
  • to comply with law or a lawful request, enforce our terms, or protect the rights, property, and safety of FusedMagic, our users, and the public;
  • in connection with a reorganization, merger, or sale of assets, subject to this Policy.

Security

We use administrative, technical, and physical safeguards — including encryption in transit, access controls, and multi-factor authentication — to protect your personal data, taking into account its nature and the risks involved. No system is perfectly secure, and we cannot guarantee absolute security.

Retention

We keep personal data only as long as necessary for the purposes described in this Policy or as required by law. Content on free or trial plans may be deleted after a limited storage window (currently around two weeks); please download anything you wish to keep. We may retain limited copies of original files for backup and troubleshooting, and — only with your consent — for service improvement.

Children

The Service is intended for business users and is not directed to children. We do not knowingly collect personal data from anyone under 16 (or the age set by your local law). If you believe a child has provided us personal data, contact us and we will delete it.

Cookies and other technologies

We use strictly necessary cookies and similar technologies to authenticate you, keep you signed in, maintain your session, and protect against abuse. Because these are essential to the Service, they cannot be turned off through the Service, though you can control cookies in your browser — disabling essential cookies may prevent sign-in. We generally treat data from these technologies as non-personal, except where local law treats identifiers such as IP addresses as personal data, or where we combine them with other personal data.

International transfers

We may process and store your personal data in countries other than your own. Where we transfer personal data across borders, we use the safeguards required by applicable law to keep it protected wherever it is handled.

Changes to this Policy

When we make a material change to this Policy, we will post a notice on this page, update the “Updated” date above, and, where appropriate, provide additional notice.
